Technical Revisions to Presidential Policy on Discrimination, Harassment, and Affirmative Action in the Workplace
We are writing to make you aware of a technical update to the UC Policy on Discrimination, Harassment, and Affirmative Action in the Workplace to comply with new state requirements under the Fair Employment and Housing Act (FEHA) and federal law.
Highlights of the updated policy include the following:
FEHA requirement that employers must develop and distribute anti-harassment and discrimination policies and create formal complaint processes to address employee concerns.
Supervisors must report complaints of discrimination or harassment to a designated representative. For a list of designated representatives, go to Report an Incident.
The University must conduct impartial and timely investigations by qualified personnel and provide appropriate options for remedial actions and resolutions.
Updated definitions of “Gender Expression” and "Gender Identity.”
Added definitions of “Transgender,” “Gender Transition,” and “Sex” to comply with definitions in the California FEHA regulations.
Reference to Discrimination and Harassment protections for volunteers, unpaid interns and trainees, and harassment protections for contractors.
Incorporation of a new pay-transparency rule, which prohibits contractors and subcontractors from discharging or otherwise discriminating against their employees and job applicants for discussing, disclosing, or inquiring about compensation.
Replacement of the definition of “Covered Veteran” with “Protected Veteran” to comply with the Vietnam Era Veterans Readjustment Assistance Act, as amended.
